- activities conducted entirely for market research purposes
- services to determine credit worthiness
- professional work in the line of a practicing barrister or solicitor’s duty
- expert activities of practising accountants
- professional undertakings by journalists and broadcasters, and actions solely connected to gathering information for use in broadcasting and journalism
- services offered to the public contained in open registers; registers or documents fully accessible to individuals; and material that has been made public
- activities in which the person that is investigated has given permission or has the knowledge about it
Charges
The sanction for working as an unregistered private examiner will be.
- upon the instant judgment at a Magistrate’s Court, District Court or Sheriff Court, a maximum punishment of six months imprisonment and/or a fine of up to £5,000
Charges for engaging unlicensed personnel will be.
- The biggest punishment of six months imprisonment and / or a fine of up to £5,000, after summary conviction at a Magistrate’s Court, Sheriff Court or District Court
- having been convicted after prosecution at a Higher Court, Crown Court, Sheriff or a Justiciary and any trial involving a jury, the maximum penalty will be imprisonment for 5 months and / or fine that is unlimited ( at the discretion of the court)
